Dubuque Veterans Disability Lawyer Explains the VA’s Take on Mental Illness
The Veteran’s Administration did not always recognize mental illness as a disability, notwithstanding years’ of solid evidence linking combat experience with post-traumatic stress disorder and various other conditions. However, mental conditions like anxiety have been recently added to the growing list of mental conditions qualifying as disabilities, which includes the following:
- Psychotic disorders;
- Anxiety including post-traumatic stress disorder, agoraphobia and other phobias;
- Dissociative disorders;
- Somataform disorders; and
- Mood, adjustment and eating disorders.
The key in obtaining your benefits is creating a causal link between your service in the military and the resulting disorder. The VA will need to see medical evidence documenting an event occurring while in the service followed by an increase in your anxiety symptoms. If your anxiety has progressed due to the natural course of the illness and is unrelated to military service, VA benefits may not be available to you; however, other disability benefits may still be an option.
Once your condition is established, the VA will give it a percentage rating based on severity. If you are unable to work at all due to your anxiety, you will receive a rating of 100 percent. Otherwise, you will receive a lower rating, and lower monthly benefits, congruent with the severity of your illness.
